Terms of Service

By accessing or using Weswap ("the Platform", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Platform.

These Terms apply to all users, visitors, and others who access or use the Platform, including but not limited to individuals who list items, request swaps, or browse available items.

Weswap is a platform that connects users who wish to swap items with each other. We facilitate these connections but are not a party to any swap agreement between users.

By using Weswap, you represent and warrant that:

• You are at least 18 years of age or the age of majority in your jurisdiction
• You have the legal capacity to enter into binding agreements
• You will comply with all applicable laws and regulations
• You are not located in a country that is subject to a government embargo
• You have not been previously suspended or removed from the Platform

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

When engaging in swaps on Weswap, you agree to:

• Only swap items that you legally own and have the right to transfer
• Accurately describe the condition and specifications of your items
• Provide clear photos showing the actual condition of items
• Honor swap requests that you accept
• Communicate in good faith with other users
• Complete the swap as agreed upon
• Not engage in any fraudulent or deceptive swapping practices

Important: Weswap is not responsible for the quality, safety, or legality of items swapped between users. All swaps are at your own risk.

The following items are strictly prohibited from being listed or swapped on Weswap:

Violation of this policy may result in immediate account termination and legal action.

You agree not to:

• Harass, abuse, or threaten other users
• Post false, misleading, or deceptive content
• Impersonate any person or entity
• Use the Platform for any illegal purpose
• Interfere with or disrupt the Platform's operation
• Attempt to gain unauthorized access to other accounts
• Use automated systems to access the Platform
• Collect user data without consent

When listing items on Weswap, you agree to:

• Provide accurate descriptions including condition, age, and any defects
• Upload clear, honest photos of the actual item
• Price or specify desired swap items fairly
• Respond to swap requests in a timely manner
• Remove listings once items are swapped or no longer available
• Not list the same item on multiple platforms simultaneously

We reserve the right to remove any listing that violates these Terms or our policies.

Weswap is currently free to use for basic swapping features. However, we reserve the right to:

• Introduce fees for premium features in the future
• Charge for featured listings or promoted items
• Implement transaction fees for high-volume users
• Modify any fees with 30 days' notice

Any fees introduced will be clearly communicated and require your explicit consent before implementation.

Users are responsible for arranging swap delivery. Options include:

• In-Person Meetups: Choose a safe, public location. Never meet at private residences alone.
• Shipping: Agree on shipping methods, costs, and tracking. Weswap does not provide shipping labels.
• Local Drop-off: Coordinate mutually convenient drop-off locations.

Safety Warning: Always prioritize your personal safety. We recommend meeting during daylight hours in public places with surveillance cameras.

In the event of a dispute between users:

1. Users should first attempt to resolve the dispute directly through our messaging system
2. If unresolved, users may request mediation from Weswap support
3. We may review evidence and provide recommendations, but cannot force resolution
4. For disputes involving fraud or illegal activity, we will cooperate with law enforcement

Weswap acts as a neutral platform and is not responsible for resolving disputes between users. Any legal claims must be pursued independently.

We may terminate or suspend your account immediately, without prior notice, for conduct that violates these Terms, including but not limited to:

• Violation of prohibited items policy
• Fraudulent or deceptive behavior
• Harassment or abuse of other users
• Multiple unresolved disputes
• Failure to complete agreed swaps

Upon termination, your right to use the Platform will immediately cease. You may appeal termination by contacting our support team.

To the maximum extent permitted by law:

• Weswap is provided "as is" without warranties of any kind
• We do not guarantee the accuracy, quality, or safety of items swapped
• We are not liable for any direct, indirect, incidental, or consequential damages
• We are not responsible for user conduct or swap outcomes
• Our total liability shall not exceed the amount paid to us (if any) in the past 12 months

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Any legal action or proceeding relating to your access to or use of the Platform shall be instituted in the courts located in Nairobi, Kenya. You agree to submit to the jurisdiction of these courts.

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

Material changes will be notified via:

• Email notification to registered users
• Prominent notice on the Platform
• Updated "Last Updated" date at the top of this page
